The Reality Around Parking Fines
We live in a society ruled by administrative process and associated rules of civil procedure.
If you decide to park how and where you shouldn't, and it is a choice, and you don't want to pay your fine, then you need your paperwork in place BEFORE you decide to park up. That's a personal choice.
That means you have to some work to do to get yourself organised BEFORE a parking fine lands through your letterbox.
There is no magic bullet like Common Law that you can rely on which will make your fine magically go away.
Sure, there are things you can do to call out authority that they are being unlawful and provide their proof of claim that they have the right to impose fines unlawfully on you.
But you MUST deal with this yourself. Or simply pay the fine, if you don't want the hassle. Again, it's a choice.
In time, I hope to have more substantial paperwork available on this page and the associated SPEEDING page.
In the meantime, I know Dave Murphy to be a fine upstanding fellow via the link to his speeding resources on the SPEEDING page and he has created an excellent resource to fight back.

Got one! Now Starting The Process! Step 1
Returning daughter's PCN. Couldn't write in blue (pen wouldn't work) across the window bit, so put stickers on.
Receipt dated at top to prove returning it within 3 days under commerce.
We had decided to open it.
Putting the original envelope as per the PDF download below with the PCN inside, in my own stamped C4 envelope so I get a proper certificate of posting.
Wording taken from the PCN: "UK Parking Control Ltd do not know the name and address of the driver. We therefore invite you, the registered keeper, to pay this Parking Charge or provide us with the name and current address of the driver so we may write to them and request payment."
You read plenty about such matters being an 'invitation' to contract and there is the word itself "We INVITE you to pay"!
Also there is no signature, no invoice, not even any so-called 'Law' being quoted.

This time, thanking me for my appeal (what appeal?) and still desperate to know who the driver was.
And the wording that I 'may' pay the PCN as per the details on the letter.
I returned the envelope again as per the PDF below.

PCN Process! Step 3
After returning envelope 2 (above) on the 17th Feb 22, envelope 3 arrived, received on 19.02.22.
This was only a VERY short time after I returned envelope 2 - wording in dowload above in step 2.
Wording on letter 3 was VERY different and included the wording:
FINAL REMINDER; UKPC may comments proceedings against you in a Sherriff Court for the outstanding amount, interest and court costs; ref to credit reference agencies; warrant may be issued for court appointed Cherriff officer to recover the payment; additional fees; debt recovery company etc.
And the amount due is now the full £100 fine.
We've gone from a nicey, nicey, letter 1 and 2 to letter 3, extorting money with threats and menaces.

We can no longer take this any further forward with just returning envelopes with suitable return wording on it.
Next Step is a Conditional Acceptance letter to the Director.

Envelope 5 appeared on 22.03.22 thanking us for our 'appeal' and notifiying us that the appeal was now 'closed'.
This appeared to have been sent in response to our return of envelope no3&4 above, with no acknowledgement of Notice No1 (above).
AND... 35 days has been given to pay the £60!!!
This is nothing more than an attempt to mess with my own 14 days deadlines, assuming they are actually referring to Notice No1 above.

Have been reading up some more on Notices and realised that my 14 day deadline for sending Notice No2 is insufficient time allowance to respond when making Notice No2 part of the court pre-action protocol for full disclosure, pre hearing. It should be a min of 21 days to stay in honour.
+ there were a couple of very minor procedural mistakes, incl not sealing off the back of the document correctly under Postal Mechanics.
I had already decided to send this reminder when the Step 8 letter (above) arrived.
So I sent a 'Reminder Notice' with a correct copy of Notice No2B Fri 08.04.22, extending the time for response by a further 7 days.
